The Federal High Court in Abuja has dismissed objections filed by African Democratic Congress (ADC) National Chairman, Senator David Mark, and the party’s National Secretary, Rauf Aregbesola, against an application by a party chieftain, Nafiu Bala Gombe, to amend his leadership suit challenging their emergence as national officers of the party.
Justice Peter Lifu, who delivered the ruling on Friday, described the objections by Mark and Aregbesola as “frivolous, baseless and without an iota of merit.”
He held that the amendment sought by Gombe was a normal step in civil litigation aimed at preventing a miscarriage of justice and noted that the request became necessary following a change of counsel.
The judge added that the fears expressed by the defendants were unnecessary because they remained free to file counter-affidavits in response to the amended originating summons.
After reviewing the objections, Justice Lifu said he found no basis for the claim
