A Federal High Court in Lagos has affirmed the powers of the Federal Competition and Consumer Protection Commission to regulate Nigeria’s digital consumer lending market, including airtime and data lending services, dismissing a suit challenging the Commission’s regulatory authority.
Justice Ambrose Lewis-Allagoa, in a judgement delivered on Monday, upheld the validity of the FCCPC’s Digital, Electronic, Online and Non-Traditional Consumer Lending Regulations; he held that they were lawfully made and fall within the Commission’s statutory and constitutional mandate.
The suit was filed by the Wireless Application Service Providers Association of Nigeria, which sought to invalidate the DEON Regulations on the grounds that the FCCPC lacked the power to regulate services within the communications sector.
However, Justice Lewis-Allagoa dismissed the suit in its entirety, clearing the way for the commission to enforce the regulations across Nigeria’s digital consumer lending ecosystem, including providers of airtime credit and data lending services.
